UNCTAD organized an Expert Meeting on Development Implications of International
Investment Rule Making, which took place in Geneva on 28 and 29 June 2007 with
the participation of experts from 54 states and representatives of various
intergovernmental and non-governmental organizations. This special feature puts
together the contributions presented at the meeting. It also seeks to bring
attention to UNCTAD's IIA-related activities, which build on more than 30 years
of experience in matters related to foreign investment, trade and development.
We would like the thank the UNCTAD secretariate (especially Dr. Joerg Weber and
Adriana Garcia Vargas) for their efforts in preparing this issue.

Dr. Irmgard Marboe from the University of Vienna
prepared this special feature on Compensation and Damages in International Investment Arbitration which attempts to shed some light on the existing approaches concerning the question of valuation in international investment disputes. It tries to do so primarily from the legal but also from the economic perspective. The authors of this issue, therefore, include both lawyers as well as valuation experts.

This new overall issue of TDM has a series of most key think pieces, articles and
numerous case comments. We invite comments - which we would be pleased to publish - in particular on Jan
Paulsson's essay on the shortcomings of domestic courts in many developing and emerging
countries which sits in almost perfect contrast with Dr van Harten's critique of ad-hoc
arbitration tribunals and his call for replacing "appointment-hungry" arbitrators with permanent
judges in a "World Investment Court".
Other highlights include: Jeffery P. Commission's work "Precedent
in Investment Treaty Arbitration: The Empirical Backing"; Large number of case comments;
Coverage of advocacy-related topics; Oil, gas and energy-related disputes...

The World Bank Guidelines as a Foundation for a Global Investment Treaty: A Problem-Oriented Approach
by Dr. Claudia Wendrich, LL.M.
The paper - following the structure of the Guidelines - addresses admission and treatment of
FDI, expropriation of foreign investments, inter-State and investor-State dispute resolution as
well as the proposed Convention's scope of application. In addition, it contains an overview of
numerous past attempts multilaterally to regulate FDI. Each chapter selects key problems which
often arise out of investment transactions, such as restrictions on admission of foreign
investors, monetary transfers and compensation for expropriated investments....
