Foreign Direct Investment (FDI) International Arbitration Moot Case 2019
The 2019 case was elaborated by Vishesh Bhatia, Marilena Chrysanthakopoulou, Veronika Lakhno, Alina Papanastasiou, and Alexandra Samsonova, under the supervision of the FDI Moot's Directors and Advisory Board.
The 2019 case involves the Respondent State blocking social media platforms for their alleged part in fomenting civil unrest. Three social media Claimants allege expropriation and violation of fair and equitable treatment, while the Respondent objects to the ICSID tribunal's jurisdiction on the basis of its denunciation of the ICSID Convention, the plurality of Claimants, and lack of a covered investment. The Respondent also seeks to enjoin the Claimants' retaliatory international media campaign while the proceedings are in progress.
