El Incierto Futuro Del Arbitraje de Inversiones en Latinoamérica
Article from: TDM 4 (2009), in Latin America
Abstract
The attitude in some Latin America countries towards investor-State arbitration has changed in recent years, especially towards ICSID arbitration. Recent examples of this are found in the cases of Bolivia, Ecuador and Venezuela. These anti-arbitration trends have been implemented using a range of measures, consisting of constitutional reforms, denunciation of the Convention on the Settlement of Investment Disputes between States and Nationals of Other States (The ICSID Convention) and termination of bilateral investment protection treaties.
