Abstract
Under the Arbitration Act 1996, appeal to the Court of Appeal is often only possible with leave of the High Court; if it refuses, then the Court of Appeal has no jurisdiction. The practical effect is severely to restrict access to the Court of Appeal, consistent with the policy of arbitrations being substantially final. However where there is no express provision that leave is required, access to the Court of Appeal may be possible subject to Supreme Court Act 1981 and CPR Part 52.
