Abstract
The case Kalmneft v Glencore in the English High Court, involving a Russian company which believed inter alia (until too late) that it could ignore London arbitration, not only raised important issues of English judicial policy regarding foreign litigants but also led to significant clarification of the scope in the Arbitration Act 1996 for challenges to jurisdiction, the criteria for extension of time applications, the meaning of "serious irregularity" and other significant matters.
