Estándar de revisión de cláusulas arbitrales. La experiencia paraguaya

Introducción

El presente artículo tiene por objeto examinar la jurisprudencia judicial reciente en el Paraguay relativa a la interacción entre el arbitraje y la justicia estatal a fin de definir si existe una inclinación hacia alguno de los estándares de revisión de acuerdos arbitrales existentes en sistemas comparados, como también el formular una propuesta sobre cuál debería ser el estándar a adoptar según la legislación paraguaya. En efecto, la interacción entre el arbitraje y la justicia estatal ha sido objeto de numerosos estudios. La tensión que existe entre ambas instituciones se observa, entre otras áreas, en la imposición de medidas cautelares, ejecuciones y anulaciones de laudos, y la cooperación para producción de pruebas. Uno de los momentos más críticos, y donde se puede verdaderamente notar esta tensión, se presenta al objetarse la validez o existencia de un acuerdo o cláusula arbitral ante, primero, un juez estatal y de manera previa a que el tribunal arbitral sea conformado o tenga la oportunidad de decidir sobre dicha objeción. En estas situaciones, el juez que analiza dicha objeción, en dicho momento, debe tomar una decisión que no perjudique la legitimidad del arbitraje. Y en la búsqueda por preservar dicha legitimidad, distintas jurisdicciones han desarrollado estándares de revisión y análisis de los acuerdos y cláusulas arbitrales cuando su validez es objetada antes que los árbitros puedan decidir sobre la cuestión. Dicho estándar no está aún bien definido en el Paraguay, por lo que, en definitiva, el presente artículo busca presentar la jurisprudencia judicial reciente sobre el dilema de la interacción entre el arbitraje comercial internacional y doméstico, y la justicia estatal en el Paraguay.

Introduction

This article aims to examine different case law available in Paraguay relating to the interaction between arbitration and national courts, in order to establish if there is some sort of preference for one of the standards of review of arbitration agreements currently existing in comparative systems, as well as proposing which standard should be adopted according to the Paraguayan legislation. In fact, the interaction between arbitration and national courts has been the subject of numerous studies. The tension between both institutions is observed in other aspects, such as preliminary injunctions, enforcement and set aside of awards, and cooperation in evidence production. One of the most critical moments, and where this tension can really be noted, is when the validity or existence of an arbitration agreement is challenged, first, before a national judge, and before an arbitral tribunal can decide on such a challenge. In this situation, the judge called to decide this challenge, at that stage, must render a decision without harming the arbitration’s legitimacy. In the search for preserving such legitimacy, different jurisdictions have developed standards of review and analysis of arbitration agreements and clauses when their validity is challenged before the arbitrators have the opportunity to decide on that issue. Such a standard is not well defined in Paraguay yet. As such, this article seeks to present recent judicial decisions concerning the interaction between international and domestic commercial arbitration, and national courts in Paraguay.
