Pursuant to Articles 1116, 1119, and 1120 of Chapter Eleven of the North American Free Trade Agreement between the United Mexican States (the "State" or "Mexico"), Canada, and the United States of America, signed by the State on 17 December 1992 and entered into force on 1 January 1994 (the "Treaty"), Espiritu Santo Holdings, LP, an enterprise incorporated under the laws of Alberta, Canada, and a foreign investor in the State ("ES Holdings" or the "Investor"), provides the State with its Notice of Intent to submit to arbitration a claim against the State for breach of its obligations under the Treaty.
El 4 de junio de 2019 al amparo del Capítulo XI del Tratado de Libre Comercio de América del Norte (TLCAN), se recibió por parte de la empresa Espíritu Santo Holdings, LP (ESH), una Notificación de Intención de someter una reclamación a arbitraje por presuntas violaciones del Gobierno Mexicano a las obligaciones contenidas en el Tratado.
ESH argumenta que distintas actuaciones del gobierno mexicano afectaron la inversión que se realizó en la empresa Lusad S. de R. L. de C.V., la cual es concesionaria para la sustitución, instalación y mantenimiento de taxímetros para el transporte público individual de pasajeros para la Ciudad de México (taxi) con sistema de geolocalización y para el desarrollo, operación y explotación de una aplicación móvil para solicitar el servicio de taxi de forma remota en la Ciudad de México.
