Summary

Arbitrage. Vordering tot vernietiging van een arbitraal vonnis wegens strijd met de openbare orde (art. 1065 lid 1, onder e, Rv), wegens een onder invloed van corruptie tot stand gekomen koopovereenkomst tussen partijen. Heeft het hof de bij de beoordeling van een vernietigingsvordering te betrachten terughoudendheid in acht genomen? Is het obiter dictum van het arbitrale scheidsgerecht een zelfstandig dragende grond voor toewijzing van de koopprijs? Heeft het hof miskend dat de partij die zich beroept op vernietiging van het arbitrale vonnis zelf heeft geprofiteerd van de corruptie?

Bariven (een dochter van het Venezolaanse staatsolie- en gasbedrijf Petrólos de Venezuela) vordert vernietiging van een arbitraal vonnis, waarin zij door een ICC-scheidsgerecht is veroordeeld tot betaling van de koopprijs van de door Wells aan haar geleverde aandrijfmotoren. Volgens Bariven is het vonnis in strijd met de openbare orde (art. 1065 lid 1, onder e, Rv), omdat het rechtsgevolgen verbindt aan een overeenkomst die door corruptie tot stand is gekomen. In de vernietigingsprocedure komt het hof tot het oordeel, anders dan het scheidsgerecht had geoordeeld, dat de koopovereenkomst het resultaat is van corruptie en wijst het hof de vordering tot vernietiging toe. In cassatie wordt onder meer betoogd dat het obiter dictum van het scheidsgerecht een zelfstandig dragende grond vormt en dat het hof de in het kader van art. 1065 lid 1, onder e, Rv in acht te nemen terughoudendheid heeft miskend.
