The New York State Bar Association has issued a brochure combining its April 2009 Guidelines for the Arbitrator's Conduct of the Pre-Hearing Phase of Domestic Commercial Arbitrations and its November 2010 Guidelines for the Arbitrator's Conduct of the Pre-Hearing Phase of International Arbitrations. These Guidelines are particularly interesting for international arbitration practitioners, as they illustrate the substantial differences between the recommended conduct of pre-hearing disclosure and pre-hearing motion practice for international arbitrations sited in New York and the recommended conduct for domestic arbitrations sited in New York. Pre-hearing disclosure and motion practice for international arbitration is carefully restricted to conform to international norms. The NYSBA International Guidelines also specifically address e-discovery along the same lines.
