Arbitration in Scotland - A New Era Dawns

Abstract
Scotland is almost alone in the world in not having a modern arbitration statute for domestic arbitration (although it enacted the Model Law for international arbitration in 1990). Its domestic arbitration law is a mixture of ancient case law (dating back at least to 1207) and piecemeal statute (back to 1695) and is riddled with anomalies and uncertainties.
