Abstract
This paper explores the challenges of
adding a standing international investment court - as suggested in UNCTAD's "Reform
of Investor-State Dispute Settlement: In Search of a Roadmap" - to the existing
investment dispute resolution system. The author addresses challenges on the
elaboration of a multilateral treaty to establish the Court, issues on
impartiality and independence of adjudicators, as well as concerns for
predictability, party autonomy and transparency.
