Introduction

The Singapore Court of Appeal in Otech Pakistan Pvt Ltd v Clough Engineering Ltd and Another ("Otech") recently ruled that the doctrine of champerty applies to arbitration proceedings. This ruling departs from Hong Kong case law which has held that the doctrine of champerty should be restricted to the public justice system. This summary of Otechwill highlight the reasons used by the Singapore Court of Appeal to extend the doctrine of champerty to arbitration proceedings.
