Highlights

On Friday 25th October, 2019 at the Auditorium of the Chamber of Commerce of Florence a conference was held on: "Cultural property: what means for the settlement of international disputes?".

The event, co-organized by the Florence International Mediation Chamber (FIMC), the international mediation service of the Florence Chamber of Commerce, and the Permanent Court of Arbitration in The Hague, has been focused on international disputes related to artworks and cultural heritage and most effective methods to solve them, including ADR instruments.

A very current topic that has actracted the interest of international law practitioners and academics. Authoritative speakers from many countries and close to 200 attendees have participated. The event has been organized in the framework of the existing cooperation agreement between the Florence Chamber of Commerce and the Permanent Court of Arbitration in The Hague.

Highlights

Part I (1h20m) - Professor Fausto Pocar's intervention questioned whether there is an "international" rule of law, David Brynmore Thomas QC touched upon investment tribunals'contribution to the protection of human rights and Ortino interestingly pointed out that the troubles that the WTO DSU is currently experiencing may have nothing to do with the DSU itself, but rather with the difficulty to reform the treaty obligations of the WTO.

Part II (1h28m) - At minute 42:30 President of the European Court of Justice Koen Lenaerts explains Achmea.

Part III (1h12m) - After Koen Lenaerts' intervention Johnny Veeder refers at the EU and international lawyers' community as two "tribes" on two sides of a mountain, whilst Prof. Adam Lazowski, who has acted as adviser in the EU-Switzerland negotiations, gives an insight in the evolution and future of the proposed EU-Switzerland Framework Agreement and its dispute resolution mechanism.

Part IV (20m) - Baroness Falkner discusses dialogue in the future EU-UK relations - and advances some proposals for reform of the EU, causing some stir among EU lawyers and academics.

Commercial, Political, and Regulatory Risks: Bringing the Rule of Law to Your Foreign Investments

Commercial, political, and regulatory risks are an integral part of investing in foreign jurisdictions. In emerging regions of the world—like Africa, Latin America, Eastern Europe, and the CIS States—these risks can be sufficiently high to deter otherwise attractive investments. A panel of Jones Day's Global Disputes Practice attorneys discusses how such commercial, political, and regulatory issues can be addressed in national courts and international arbitral tribunals. Following this discussion, a distinguished panel of corporate counsel share their practical experience and insights on how national courts and tribunals may and do bring the rule of law to jurisdictions that lack the ability or temerity to protect legitimate foreign investments. The panels are followed by a keynote address from Judge Stephen Schwebel, a leading arbitrator and former judge and President of the International Court of Justice.
