Article from: TDM 6 (2007), in Compensation and Damages in International Investment Arbitration
Introduction
This essay discusses a number of developments out-side of the United States concerning punitive dam-ages, such as proposed revisions to the civil code in France that would allow the awarding of punitive damages in civil actions and court decisions in Aus-tralia, Canada and Spain enforcing American awards of punitive damages. These developments may signal a change in the way other countries view American awards of punitive damages and may ultimately lead to greater enforcement of these damages.
