Introduction

On May 22nd 2008, the French Working Group of the ICC adopted a paper which formally rejected[1] the proposals of the Report on the Application of the Regulation Brussels I written by Prof. Burkhard Hess, Prof. Thomas Pfeiffer and Prof. Peter Schlosser in 2007.[2] The position paper of the French Working Group is currently being circulated among those interested in international arbitration in Europe.[3] This response addresses the objections forwarded in the French paper and thereby clarifies our proposals for an improvement of arbitration in the context of European procedural ...
