Introduction

This is third annual update of investment treaty arbitration at the ICSID by Linda A. Ahee and Richard E. Walck. While the year 2009 saw many of the trends from past years continue, they note some new twists, as well. Claimants were successful in less than one-half of the matters that went to an award, although in monetary terms, claimants appear to have been a bit more successful than in the past. On the other hand, more claimants discontinued their actions in 2009 than in any year since 2002.
