The author's posting on the OGEMID list-serve of an announcement about the award on jurisdiction in the Phoenix case prompted a discussion about the definition of investment and several related topics, notably about the question of whether there is a need to distinguish between good and bad investments, whether host states and arbitrators are capable of distinguishing them and what stage of arbitration proceedings is appropriate for such investment evaluation.
