Introduction

In 2009, the number of known treaty-based investor-State dispute settlement cases filed under IIAs continued to grow. Tribunals rendered significant awards on issues relating to the definition of investment, most favoured nation treatment, expropriation and fair and equitable treatment. The new IIA issues note reviews the most recent developments in investor-State disputes and the significant awards rendered in 2009.
