The issues associated with challenging arbitrators, either on appointment, or subsequently, have been extensively aired in recent years and there is considerable jurisprudence on the topic, most notably the English Court of Appeal case AT&T v Saudi Cable. In addition, the IBA has recently promulgated new Guidelines concerning arbitrator independence and disclosure.
