Introduction

The first arbitration courts were established in the Republic of Kazakhstan ("RK") in 1993, after the collapse of the Soviet Union. Between then and 2004, when the RK adopted legislation on arbitration, there has been some doubt about the ability and willingness of Kazakhstani courts to enforce arbitral awards.
