Introduction

Assuming that we are still able to be shocked by anything, one could perhaps say that one of the very shocking things nowadays is that mediation receives in many jurisdictions quite a cool reaction, except for common law countries which are in this respect a happy island surrounded by a sea of troubles. The reasons for this surprising reaction will be examined in this paper.
