Abstract

In this article, Strawbridge discusses the effect of the Appellate Body's ruling in US - Clove Cigarettes on U.S. trade policy under the Obama administration. The structure of this paper is as follows: (1) in Part 1, Strawbridge sets out the political controversy which led to the Obama administration's efforts to include tobacco-specific provisions in the Trans-Pacific Partnership ('TPP'); (2) in Part 2, Strawbridge turns to look at the nature of the U.S. TPP proposal and the specific nature of the proposed 'carve out' for tobacco products, including projected limitations; (3) ...
