Introduction
The U.S. Government released in April 2012
a newly revised version of its model bilateral investment agreement (the 2012
U.S. Model BIT). In the end, the 2012 U.S. Model BIT is not so very different
from the 2004 version of the U.S. Model. Critics of investor-State arbitration
were particularly disappointed, as the U.S. government determined to maintain
the provisions of the 2004 Model BIT with few changes.
