Introduction

Part I of this paper begins with a brief sketch of some of the most significant methodological challenges raised by this genre of empirical research, including how some of those challenges affect empirical research regarding investment arbitrators. The assessment of empirical methodology provides a backdrop to the analysis of issues in the remainder of the paper. Part II offers an evaluation of selected reforms that have been proposed for investment arbitration based, in part, on some findings in empirical research.
