Introduction

With more than one quarter of all known investor-State dispute settlement (ISDS) cases brought against it, Latin America has been one of the most arbitrated against regions. The initiation of recent disputes against Latin American parties and the number of related decisions delivered confirms this as a continuing trend. The present article gives an overview of ISDS developments concerning Latin America in the two most recent years, focusing notably on newly-released statistics and outcomes in ISDS cases and jurisprudence for such in the jurisdiction, merits and post-merits phases.
