Abstract

This paper considers various situations which may arise in the relationship between state courts and the new Investment Court System (ICS) proposed by the European Commission for the Transatlantic Trade and Investment Partnership (TTIP) agreement, including the relationship between proceedings before state courts and proceedings before the investment courts, enforcement of the investment courts' decisions by the state courts of the contracting parties and by courts of non-contracting parties, and the impact of annulment proceedings.
