Abstract

Insolvency mediation, which represents quite a novelty in EU law, seems to be a topical issue for the new approach to insolvency, which the Proposal for a Directive of 22 November 2016 lastly envisages. In this perspective, the study is aimed at examining the legal foundation of insolvency mediation and the role of the EU in developing the recourse to mediation in insolvency-related matters.
