Abstract

The Energy Charter Treaty's coverage of sustainable energy resources remains incomplete. This could be addressed by amending the Treaty, particularly by redefining economic activity in the energy sector. However, this is challenging to do as the energy sector integrates increasingly with other sectors. Defining an energy sector boundary and extending ISDS to demand-side management, however, could be sub-optimal and alternatives should be evaluated.
