Introduction
Thank you very much for the invitation to come here and participate with this panel. In fact our chairman pointed out the text of relevant treaties - basically BITs. As Professor Schreuer indicated before, they are not in any way identical. Therefore the starting point should be the text of the relevant treaty itself. The treaty between Argentina and France for instance, which was relevant in the Vivendi case, speaks about any disputes relating to investment and spells out that if such dispute could not be solved within 6 months, it shall be submitted that the request of ...
