Abstract

[Note: this paper is in Portuguese only] The purpose of this paper is to analyze the Cooperation and Facilitation Investment Agreements executed by the Brazilian Government since 2015 ("ACFIs"). After identifying the historical reasons that lead to the development of the ACFIs (1.1), this paper will detail their pillars necessary to allow the achievement of the goals established by the Brazilian Government (1.2). Then, this paper will analyze the classic and innovative substantive protections (2.1) and dispute resolution mechanisms (2.2) set out in the ACFIs.

Resumo

Este artigo tem como objeto a análise dos Acordos de Cooperação e Facilitação de Investimentos celebrados, desde 2015, pelo governo brasileiro (“ACFIs”). Constatadas as razões históricas que levaram ao desenvolvimento dos ACFIs (1.1), serão detalhados seus pilares, necessários para que os acordos atinjam os fins almejados pelo governo (1.2). Por fim, passa-se a uma análise das proteções materiais (2.1), sejam elas clássicas ou inovações, e mecanismos de resolução de controvérsias (2.2) previstos nos ACFIs.
