Rapport du Club des Juristes Sur le Financement de Procès Par Les Tiers (Les Club des Juristes, Juin 2014)

Ce rapport se propose d’analyser l’activité de finan­cement de procès sous le prisme du droit français. A ce titre, il fait force de propositions d’abord en matière contractuelle, en abordant l’épineuse question de la qualification de l’opération (I) et en analysant certaines clauses ou situations problématiques (II). Ensuite, le rapport aborde les difficultés d’articulation avec le monopole bancaire français en matière d’opération de crédit (III) et avec les règles déontologiques des avocats (IV). Enfin, le rapport consacre des développements substantiels et spéci­fiques sur les difficultés que pose l’activité de financement de procès en droit de l’arbitrage (V) et se termine par une liste de propositions concrètes pour gérer les problématiques posées par cette nouvelle activité.

This Report analyses third party funding through the prism of French law. In that context, it examines the thorny question of the contractual nature of the phenomenon (I) and analyses the issues raised by certain provisions or situations (II). The Report further looks at the tension between third party funding and the banks’ monopoly on credit operations in France (III) and with the ethical rules governing French avocats (IV). Finally the Report provides substantive and specific treatment of the difficulties presented by third party funding in the law of arbitration (V) and ends with a list of concrete proposals aimed at dealing with the issues raised by this new field of activity.
