The petitioner, Olin Holdings Limited ("Olin"), brought this action against the respondent, the State of Libya ("Libya"), seeking to confirm a final arbitral award (the "Final Award") issued by the Arbitral Tribunal (the "Tribunal"} of the International Chamber of Commerce (the "ICC") in Paris, France. See Pet., ECF No. 1-1. Libya opposes Olin's petition pursuant to Article V(l) (c) of the Convention on the Recognition and Enforcement of Foreign Arbitral Awards, June 10, 1958, 21 U.S.T. 2517, 330 U.N.T.S. 38 - commonly known, and referred to herein, as the "New York Convention" - and, in the alternative, moves to dismiss Olin's petition on forum non conveniens grounds. For the reasons that follow, Olin's petition to confirm the Award is granted, and Libya's motion to dismiss is denied.
