Further to Shimon Mistriel Aykout remaining in custody for charges of money laundering, medical tests, that used technology unavailable in Cyprus and were performed by a doctor licensed in the UK, following the request of the defendant, affirmed that the defendant suffers from cancer. The Court noted that no allegation of cancer was put forward before the first instance court and reviewed the relevant jurisprudence of the ECtHR. It reiterated that medical treatment provided within prison facilities must be appropriate, that is, at a level comparable to that which the State authorities have committed themselves to provide to the population as a whole. It further repeated the approach that states are not under the general obligation to release prisoners on health grounds. Under assessment of the particular facts of the case at hand, the Court did not find a reason for releasing the defendant.
