Summary

This is my judgment on an application by the claimant (the “Claimant”) to stay an in rem action. The Claimant relies on two alternative grounds for seeking a stay: (a) pursuant to s 6 of the International Arbitration Act 1994 (2020 Rev Ed) (the “IAA”); and (b) alternatively, pursuant to the court’s case management powers. This application raises interesting questions relating to whether a claimant may bring an application under the IAA to stay proceedings that the claimant started.
