Summary

In this arbitration claim, Seacrest Group Ltd ("Seacrest") mounts a challenge under s.68 of the Arbitration Act 1996 (the "1996 Act") to a final arbitration award dated 27 September 2024 (the "Award"). The arbitration was between Seacrest as claimant and BCPR Pte Ltd and Bangchak Corporation Public Company Limited as respondents. For the purposes of this judgment there is no need to distinguish between the two BCP entities and I shall refer to them separately and together as "BCP". The arbitration was conducted under the terms of the UNCITRAL Arbitration Rules (2021). The Tribunal comprised Mr Stuart Isaacs KC, Mr Jasbir Dhillon KC and Prof Benjamin F Hughes.
