Defendant, the National Bank of Ukraine, is a separate legal person wholly owned by Ukraine and is responsible for regulating and supervising commercial banking within Ukraine. As such, it is an "agency or instrumentality of a foreign state" within the meaning of 28 U.S.C. § 1603(b).
