Summary
HC/OA 586/20256 ("OA 586") is an application by Essar Exploration and Production India Limited ("Essar") for a partial setting aside of the Final Award dated 25 February 2026 ("Award") made by the arbitral tribunal ("Tribunal") in the arbitration ("Arbitration") between Essar and Nayara Energy Limited ("Nayara"), the respondent.
Essar brings its application on four main grounds pursuant to s 24(b) of the International Arbitration Act 1994 (2020 Rev Ed) ("IAA") and/or Art 34(2)(a)(ii) of the UNCITRAL Model Law on International Commercial Arbitration ("Model Law") that there were material breaches of natural justice.
Having considered the arguments, I dismiss Essar's application, and I set out my reasons below.
Arbitration - Award - Recourse against award - Setting aside - Tribunal failing to consider essential issues and not relying on chain of reasoning with nexus to parties' arguments - Whether breach of natural justice occasioned - Section 24(b) International Arbitration Act (2020 Rev Ed) - Remission - Multiple errors and disregard of errors - Whether matter should be remitted to tribunal - Article 34(4) UNCITRAL Model Law on International Commercial Arbitration
