Summary

IN THE MATTER of Sections 25 and 26 K of the Arbitration Ordinance (Cap 609) and Articles 12 and 13 of the L UNCITRAL Model Law on International Commercial Arbitration

The Plaintiff ("R") commenced these proceedings by an originating summons dated 2 September 2025 ("OS") pursuant to section 26 of the Arbitration Ordinance Cap 609 ("AO"). By the OS, R requests the court to decide its challenge ("Challenge") against the appointment of XXXX XXX XXX XXX ("SS") as an arbitrator in an arbitration ("BIT Arbitration") administered by the Hong Kong International Arbitration ("HKIAC") under the 2024 Administered Arbitration Rules ("HKIAC Rules"). The Challenge was previously dismissed on 14 August 2025 by the Proceedings Committee of the HKIAC ("Proceedings Committee") for the reasons contained in the Recommendation on Challenge dated 13 August 2025 ("Recommendation").
