The 11th Circuit Court of Appeals today upheld a Section 1782 discovery order with respect to an international commercial arbitration. JAS Forwarding (USA), Inc., Defendant, and Jet Air Service Equador S.A. Intervenor Appellant (11th Cir. Case No. 11-12897, June 25, 2012) the court of appeals held that "the arbitral tribunal before which JASE and CONECEL's dispute is now pending is a foreign tribunal for purposes of" Section 1782.
