Summary
In a decision rendered on 9 October 2012, under the Agreement between the Kingdom of the Netherlands and the Republic of Paraguay on the Encouragement and Reciprocal Protection of Investments (1994), an ISCID Tribunal stayed proceedings related to Article 3(1) and Article 3(4) claims until after the Claimant sought recourse for a contractual dispute through domestic courts.
