Profile

Nathan Cunningham is an associate in Weil's International Arbitration & Trade practice. Mr. Cunningham focuses on antidumping and countervailing duty (AD/CVD) trade litigation proceedings, customs matters, and WTO litigation, in addition to government and internal investigations and compliance counseling. He has represented clients across a range of industries, including the chemical, steel, paper, automotive, agricultural, textile & apparel, and mining sectors.

Mr. Cunningham has extensive experience in AD/CVD proceedings before the U.S. Department of Commerce and International Trade Commission, including original investigations, administrative reviews, sunset reviews, and Section 129 determinations (i.e. U.S. administrative proceedings following adverse outcomes in certain WTO dispute settlement matters). His work in these proceedings includes: Carbon And Alloy Steel Cut-To-Length Plate; Cold-Rolled Steel Flat Products; Frozen Warmwater Shrimp; Hot-Rolled Steel Flat Products; Melamine; Polyethylene Terephthalate (PET) Resin; Softwood Lumber; Steel Nails; Supercalendered Paper; Uncoated Paper; and Welded Line Pipe. He has participated in eight onsite verifications conducted by the U.S. Department of Commerce pursuant to antidumping investigations.

Mr. Cunningham also has assisted clients regarding customs classifications and country of origin determinations pursuant to internal investigations, new product development, prior disclosures, and US Customs and Border Protection requests for information. Additionally, Mr. Cunningham counsels clients regarding due diligence and compliance relating to international economic sanctions, export controls, Committee on Foreign Investment in the United States (CFIUS) proceedings, and other trade regulatory issues. He also represents clients in white-collar criminal defense, internal investigations, World Bank disbarment proceedings, and FCPA matters.

Prior to joining Weil, Mr. Cunningham worked at another major Washington D.C. based law firm and previously served as a Legal Intern in the United States Trade Representative's Office of the General Counsel. He received a. J.D. from American University, Washington College of Law and a B.A. from the University of Michigan.
