Digitalizing Dispute Resolution Processes: the Example of Denmark

by Sylvie Cécile Cavaleri

Abstract

(Addendum June 2018) Globalization and the increasing number of legal disputes at both consumer and commercial levels create the need for effective and less costly dispute resolution. The establishment of online dispute resolution processes can contribute to achieving these goals, in several manners. The article discusses the digitalization of dispute resolution processes in Denmark in three different areas (consumer claims, civil disputes and criminal cases). It reaches the conclusion that digitalization presents undeniable advantages, but also raise some concerns the consequences of which are not fully known yet.

Presented at the Center for International Legal Studies (CILS) "International Mediation Symposium" which was held in Salzburg, Austria, 8 - 11 June 2017. Chair: Mr. Hon. Ken Fields. More information www.cils.org
